These Terms of Service ("Terms") govern your access to and use of Droplink ("Service," "we," "us," or "our"), a Spotify landing page creation and conversion tracking platform available at droplink.fm.

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

Droplink is a conversion rate optimization (CRO) engine that allows users to create landing pages for Spotify content (tracks, albums, playlists, and artists) with integrated Meta Pixel and Conversions API (CAPI) tracking.

The Service includes:

• Landing page creation and customization
• Meta Pixel and CAPI integration
• Analytics and conversion tracking
• Custom domain support (paid tiers)
• A/B testing capabilities (paid tiers)
• AI optimization features (paid tiers)

To use Droplink, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You may not create an account using false or misleading information, or on behalf of someone other than yourself without authorization.

Droplink offers a tiered subscription model:

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Distribute malware, viruses, or harmful code
• Engage in spam, phishing, or fraudulent activities
• Harass, abuse, or harm others
• Impersonate any person or entity
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to the Service
• Scrape, crawl, or use automated means to access the Service without permission
• Create landing pages for content you do not have rights to promote
• Use the Service to promote illegal content or activities

The Service and its original content, features, and functionality are owned by Droplink and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written permission.

Droplink, the Droplink logo, and any other product or service names are trademarks of Droplink. You may not use these marks without our prior written permission.

You retain ownership of all content you create using the Service, including landing pages, text, and configurations ("User Content").

By using the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of providing the Service to you.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the rights of third parties
• Your User Content complies with these Terms and applicable laws

The Service integrates with third-party services including Spotify, Meta (Facebook/Instagram), and Stripe. Your use of these services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, content, or practices of third-party services. Any use of third-party services is at your own risk.

You are responsible for ensuring you have the necessary rights and permissions to use Meta Pixel and Conversions API with your landing pages.

To the maximum extent permitted by law, Droplink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Accuracy, reliability, or completeness of content
• Uninterrupted or error-free operation
• Security or freedom from viruses or harmful components

We do not guarantee any specific results from using the Service, including conversion rates or revenue improvements.

You agree to indemnify, defend, and hold harmless Droplink, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of third parties
• Your use of Meta Pixel or Conversions API

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, effective immediately.

You may terminate your account at any time by deleting your account through the Service settings.

Upon termination:

• Your right to use the Service will immediately cease
• Your landing pages will be deactivated
• Your data will be deleted according to our Privacy Policy
• You will not be entitled to any refunds (unless required by law)

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You and Droplink agree to submit to the personal jurisdiction of the courts located in the United States for any actions not subject to arbitration.
